1. Agreement to Terms

By accessing and using the CYBERDUDEBIVASH AI Security Hub platform ("Platform") operated by CYBERDUDEBIVASH PRIVATE LIMITED, you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service.

2. Service Description

CYBERDUDEBIVASH AI Security Hub is a cloud-based AI-powered cybersecurity platform providing:

• Vulnerability scanning and assessment tools
• Real-time threat intelligence and analysis
• AI-driven security defense solutions (Sentinel APEX, MYTHOS AI)
• Marketplace for defense tools and security resources
• Compliance monitoring and reporting

3. Account Registration and Use

To access premium features, you must create an account by providing accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your password and account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access to your account
• Using the platform in compliance with all applicable laws and regulations

4. Subscription Plans and Pricing

5. Payment and Billing

Payment for subscriptions is processed through Lemon Squeezy, our payment processor. By subscribing, you authorize Lemon Squeezy to charge your selected payment method. Subscription charges are recurring and will continue until cancellation.

• Charges occur monthly on the same date as your subscription start date
• You can cancel your subscription anytime through your account dashboard
• Refund policy applies as per our Refund Policy document
• Failed payments may result in service suspension

6. Acceptable Use Policy

You agree NOT to use the Platform for:

• Illegal activities or violating any laws or regulations
• Scanning systems you do not own or have explicit authorization to test
• Distributing malware, viruses, or harmful code
• Unauthorized access attempts or network intrusions
• Harassment, abuse, or threatening behavior toward other users
• Reverse engineering or circumventing security measures
• Competitive intelligence gathering without authorization
• Any form of fraud or misrepresentation

7. Intellectual Property Rights

All content, features, and functionality of the Platform, including but not limited to software, design, text, graphics, and logos, are owned by CYBERDUDEBIVASH PRIVATE LIMITED or our licensors and are protected by international copyright laws. Your use of the Platform does not grant you any rights to use our intellectual property.

The defense tools available on our marketplace are subject to their respective licenses and intellectual property terms as displayed on the Platform.

8. User Content and Responsibility

You retain ownership of any content you upload to the Platform. By uploading content, you grant us a non-exclusive license to use it for service improvement and analytics purposes. You are solely responsible for ensuring your uploaded content does not violate any laws or third-party rights.

9. Refund Policy

Please refer to our complete Refund Policy for detailed information on refunds, cancellations, and return procedures. In summary:

• Digital products are generally non-refundable after 7 days of use
• Unused scan credits may be refunded within 7 days
• Refund requests must be submitted within 7 days of purchase
• Approved refunds are processed within 5-7 business days

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERDUDEBIVASH PRIVATE LIMITED SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data, revenue, or business opportunities
• Damages resulting from unauthorized access to your account
• Service interruptions or unavailability
• Accuracy or completeness of threat intelligence reports

Our total liability shall not exceed the amount you paid in the last 12 months of service.

11. Disclaimer of Warranties

The Platform is provided "AS IS" without warranties of any kind, express or implied. We do not warrant that:

• The service will be uninterrupted or error-free
• All vulnerabilities will be detected
• The service will meet your specific requirements
• Third-party services will function without interruption

12. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of India, including:

• Information Technology Act, 2000
• Consumer Protection Act, 2019
• Indian Penal Code applicable provisions

You agree to submit to the exclusive jurisdiction of courts in Odisha, India.

13. Dispute Resolution

Before initiating legal proceedings, disputes shall be resolved through:

1. Good faith negotiation between parties (15 days)
2. Mediation if negotiation fails (30 days)
3. Arbitration under Indian Arbitration and Conciliation Act, 1996 if mediation fails

14. Termination

We reserve the right to terminate your account and access to the Platform if:

• You violate these Terms of Service
• You engage in illegal or harmful activities
• You fail to pay subscription fees
• We determine your use poses a security risk

Upon termination, your data will be retained per our Privacy Policy and applicable laws. You may request data deletion after termination.

15. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Platform. We will provide notice of material changes when possible. Continued use after notification constitutes acceptance of changes.

16. Third-Party Services

Our Platform integrates with third-party services including Lemon Squeezy (payments) and Cloudflare (hosting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service interruptions or issues.

17. Export Compliance

The Platform and its content are subject to Indian export control laws. You agree not to export or re-export the Platform or its content without proper authorization.
